Click2Mail complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Click2Mail has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Click2Mail has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. This Privacy Policy covers Click2Mail and applies to all customer information that Click2Mail obtains when a customer registers for or uses a Click2Mail online service, including visiting a Click2Mail owned and controlled web site (a "Click2Mail Web Site"). Top Level Domains (TLDs) covered by this Privacy Policy are: Click2Mail.com and Click2EDDM.com. This privacy policy also applies to the “ZendaNote”, “Click2Mail Dashboard” and “Mail-It Now” mobile applications as well as the “Click2Mail CRM Hub”, “MailJack+” and “Directory Monitor” applications (collectively, the "Service").

From time to time Click2Mail may offer special promotions, contests or other unique marketing efforts which would be governed by their own specific terms and conditions. By choosing to participate in any such marketing effort you consent to the terms and conditions specific to such marketing effort taking precedence over this Privacy Policy, except that to the extent there is any conflict between such specific terms and the Principles, the Principles shall govern as may be required by the EU-US, Swiss-US and UK-US Data Privacy Framework.

Definitions

"Customer Information" consists of all information which can be associated with a specific individual or entity, including, for example, a recipient's name, address, telephone number, and email address, credit card or other payment information, and information about online activities that are directly linked to the Customer.

"Printed Material" is the content provided by users for mailing to their recipients, including the design, text, formatting of such content, and such content in both digital and printed form.

"List Information" consists of all information provided by users to us regarding the intended recipients of their mailings generated through your use of the Click2Mail Service.

Information We Collect

Information Provided By Customers: Click2Mail collects Customer Information, Printed Material, and List Information.

Click2Mail collects Customer Information for the purpose of creating an account, tracking use of the Service, processing printing orders, and billing for and receiving payments. Click2Mail acts as a controller of Customer Information.

Click2Mail collects Printed Material for the purpose of printing the letters or other correspondence as directed by customers. Printed Material includes the contents of the postal communications that you transmit using Click2Mail services. Click2Mail acts as a processor of Printed Material.

Click2Mail collects List Information for the purpose of mailing the letters or other correspondence as directed by customers. Click2Mail acts as a processor of List Information.

If Click2Mail subsequently seeks to use Customer Information, Printed Material and/or List Information for purposes other than the purpose for which it was originally collected or subsequently authorized by you, Click2Mail will provide you with the opportunity to exercise your choice to opt-in to that specific use.

Information Collected by Operation of our Service:

During the course of your use of the Click2Mail Web Site and internet services, we automatically track and store certain information about your visit that is generated by the operation of the Internet itself. This information may include the URL that you just came from (whether this URL is on our site or not), which URL you next go to (whether this URL is on our site or not), what browser you are using, and your IP address. We use this information in the normal operation of the Click2Mail Service. Click2Mail acts as a controller of this information.

Click2Mail will collect and use Customer Information, Printed Material, and List Information for the purposes for which you submitted it to the Click2Mail Service. Click2Mail regards Printed Material and List Information (collectively, “Content”) as the private information of the Customer. Accordingly, Click2Mail will not sell, trade, rent or disclose to third parties any Content that a Customer provides except pursuant to the Customer’s direction or as described below.

Click2Mail regards Customer Information as private to the Customer and as proprietary information for Click2Mail. Click2Mail will not sell, trade, rent or disclose to third parties any Customer Information -- including your names and addresses – for their marketing purposes.

Click2Mail reserves the right to use or share your information, without notice to you or your consent, to respond to duly authorized information requests of governmental authorities, including to meet national security or law enforcement requirements, or where required by law or in the vital interests of a customer such as when life or health are at stake. Note that Click2Mail is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). We may also provide your information to a third party in connection with the sale, assignment, or other transfer of the business of Click2Mail to which the information relates, in which case we will require any such buyer to agree to treat your information in accordance with this Privacy Policy. Click2Mail may disclose to third parties aggregated information that does not allow any individual Customer to be identified. Click2Mail will take commercially reasonable efforts to aggregate such information sufficiently so that no Customer can be identified.

Third-Party Cookies, Tracking, and Targeted Advertising

Click2Mail does not allow third-party tracking or targeted advertising cookies on its Click2Mail Web Site or its Service.

Security

Click2Mail has implemented technology and security features and strict policy guidelines to safeguard the privacy of your customer information from unauthorized access or improper use, and we continue to enhance our security procedures as new technology becomes available.

Click2Mail's physical facilities are very secure. Our production facilities are monitored with surveillance cameras and access to production areas is limited to select employees only and controlled by electronic badge entry.

E-mail and Postal Mail Contents

Click2Mail will not read or disclose to third parties private postal or electronic communications that you transmit using Click2Mail services except as required to operate the service or as otherwise authorized by law (see "Disclosure" section above). We consider your mailing lists and documents to be your private information. All document and list files you submit will be used solely to provide you with Click2Mail's products and services and in compliance with this Privacy Policy.

Unlawful Conduct and Disclosures to Law Enforcement

Click2Mail may use customer information to investigate and help prevent potentially unlawful activity, activity that threatens the network or otherwise violates our Terms of Service, or to exercise or defend legal claims.

Click2Mail and its vendors and contractors may use Customer Information, Printed Material, or List Information when cooperating with the U.S. Postal Service and any U.S. or non-U.S. law enforcement or governmental agency for purposes of law enforcement and compliance with postal regulations.

That cooperation includes but is not limited to, Click2Mail voluntarily disclosing (i.e., without being subject to a lawful order to disclose) to the U.S. Postal Service, and any U.S. or non-U.S. law enforcement and/or governmental agency any or all Customer Information, Printed Material, and List Information, to prove compliance with postal regulations or as otherwise required by applicable law and regulations,

Collection of Information by Third Party Sites

Our policy addresses the use and disclosure of information we collect from you. To the extent that you disclose your information on other third-party sites, different rules may apply to their use or disclosure of your personal information. In the case of dealers and resellers of Click2Mail services or Click2Mail co-branded services, we exercise commercially reasonable efforts to cause such persons to honor the provisions of this Privacy Policy, but we cannot be held responsible if they fail to do so. Transfer of Control/Sale of Business
